1. Introduction

Welcome to ModaForge. By accessing or using our AI outfit generator service at modaforge.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using the Service. If you do not agree, please do not use the Service.

2. Service Description

ModaForge provides AI-powered outfit generation that lets you upload garment images, select virtual AI models, and generate professional outfit images for e-commerce use. Some features may be available without signing in, while other features may require an account, subscription, credits, or payment. ModaForge is an independent product built around third-party AI model providers; unless explicitly stated otherwise, ModaForge is not affiliated with or endorsed by the underlying model providers.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate information when creating an account and notify us immediately of any unauthorized use or security breach.

4. Acceptable Use and Prohibited Content

By using our Service, you agree to:

Use the Service in compliance with all applicable laws and regulations
Not attempt to circumvent any limitations or security measures
Not interfere with or disrupt the Service or servers

You may not use the Service to generate or attempt to generate:

Any NSFW, sexually explicit, nude, semi-nude, sexually suggestive, or pornographic content
Content that violates any applicable laws or regulations
Hateful, discriminatory, or offensive content
Content that infringes on intellectual property rights, including uploading garment images you do not own or do not have the right to use
Content intended to harass, abuse, exploit, or harm others
Violent, deceptive, fraudulent, or otherwise harmful content
Content depicting minors in inappropriate contexts
False endorsements, impersonations, or defamatory content using AI models
Spam, malware, or other harmful content

You may not resell or redistribute generated images as a standalone product without adding material value. We may block, remove, refuse to process, or restrict access to content or accounts that violate these Terms.

Reporting Violations

If you encounter content that you believe violates these Terms or our acceptable use policy, please report it to us at support@modaforge.com with the subject line "Content Report." When submitting a report, please include:

A description of the content you believe is violative
The URL or identifier of the content (if available)
The reason you believe the content violates our policy
Your contact information (optional, but helpful for follow-up)

Content Moderation Mechanism

We are committed to maintaining a safe and compliant platform. Our content moderation process works as follows:

Receipt of Report: Upon receiving a report, we acknowledge receipt within 24 hours.
Initial Review: Our moderation team conducts an initial review within 48 hours of receipt to assess whether the reported content potentially violates our policies.
Investigation: If the initial review indicates a potential violation, we conduct a thorough investigation, which may include reviewing the reported content, the user's account history, and the context of the alleged violation.
Action: If we determine that content violates our policies, we may take one or more of the following actions:
- Remove or block the violative content
- Issue a warning to the user who generated the content
- Restrict or suspend the user's account
- Report illegal content to the appropriate authorities
Notification: We notify the reporter of the outcome of our review (if contact information was provided) and notify the user whose content was reported of any action taken.
Appeals: Users whose content has been removed or whose account has been restricted may appeal the decision by contacting support@modaforge.com within 14 days of the action.

We strive to complete the review process within 5 business days of receiving a report. Complex cases may require additional time.

5. User Content and Intellectual Property

Your Garment Images: You retain ownership of the garment images you upload. By uploading them, you grant ModaForge a worldwide, non-exclusive license to process them through our AI providers solely to generate outfit images for you. You represent that you own or have the necessary rights to upload each garment image.

Generated Images: You own the rights to the outfit images you generate with ModaForge. All plans, including Free, may use generated images for commercial purposes, including online stores, advertising, and social media. You are responsible for ensuring that your uploads and resulting outputs do not infringe third-party rights.

AI Models: Virtual AI models are created using ModaForge's technology. You have the right to use the models you create within the Service for generating outfit images. The underlying model technology remains the property of ModaForge.

6. Privacy and Data Protection

Our privacy practices are described in our Privacy Policy. We follow a minimal data collection approach: your uploaded garment images and AI model attributes are processed solely to generate outfit images and are retained until you delete them. For more details, please review our Privacy Policy.

7. Credits, Billing, and Cancellation

ModaForge uses a credit-based system:

Each outfit generation consumes 10 credits.
Creating AI models does not consume credits.
Credits are allocated based on your selected plan and are valid for the plan's billing period.
Unused credits expire at the end of each billing period and do not roll over.
Credits are non-transferable and non-refundable.
Paid features are billed in advance for the selected billing period.

You can manage or cancel your subscription at any time through the subscription management portal. Cancellation generally stops future renewals but does not retroactively cancel benefits already provided for the current billing period, unless required by law.

8. AI-Generated Content Disclaimer

Our outfit generation service is powered by the Nano Banana Pro AI model for both virtual model generation and outfit try-on image generation. AI-generated images are produced by machine learning models and may contain imperfections, artifacts, or unexpected results. We do not guarantee that any generated image will meet your specific requirements or be suitable for a particular purpose. You are responsible for reviewing generated images before using them commercially.

9. Refunds and Support

As a general rule, purchases of digital products and credits are non-refundable. If you have a refund request or billing issue, please contact us at support@modaforge.com. We review refund-related requests on a case-by-case basis and will generally respond within 3 business days. Nothing in these Terms limits any mandatory rights you may have under applicable law.

10. Service Availability

While we strive to maintain continuous service availability, we do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

11. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms. You may close your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately.

12. Limitation of Liability

The Service is provided "as is" without any warranties. To the maximum extent permitted by law, ModaForge shall not be liable for any damages arising from the use of the Service, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
